[PUBLISHED] [Colloton, Author, Melloy and Shepherd, Circuit Judges] Criminal case - Sentencing. This court's decision in U.S. v. Pulliam, 566 F.3d 784 (8th Cir. 2009) is still controlling law, and the district court correctly determined that defendant's conviction for unlawful use of a firearm under Mo. Rev. Stat. Sec. 571.030.1(4) is a crime of violence under the force clause of Guidelines Sec. 4B1.2(a)(1). 153801P.pdf 03/21/2017 Mandy Liles v. C.S. McCrossan, Inc. U.S. Court of Appeals Case No: 15-3801 U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Shepherd, Author, with Gruender and Beam, Circuit Judges] Civil case - Employment Discrimination. Plaintiff's complaints about discrimination against a fellow female employee and inappropriate conduct by a male co-worker were too distant in time to establish causation and retaliation for protected conduct; nor was there evidence from which a jury could infer a discriminatory motive and plaintiff could not establish the causation element of her prima facie case of retaliation and reprisal; with respect to her gender discrimination claim, the district court did not err in concluding that, assuming plaintiff made a prima facie case, defendant had established a legitimate, non-discriminatory ground for her discharge which plaintiff failed to show was a pretext for gender discrimination; with respect to plaintiff's hostile work environment claim, she failed to show that the harassment affected a term, condition or privilege of her employment. 161334P.pdf 03/21/2017 United States v. Eric Price U.S. Court of Appeals Case No: 16-1334 U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Per Curiam - Before Riley, Smith and Kelly, Circuit Judges] Criminal case - Sentencing. The district court did not err in determining defendant's conviction for attempted-aggravated-assault under Kan. Stat. Ann. Sec. 21-3410(a) (2007) required violent force and fell within the force clause of Guidelines Sec. 4B1.2(a); no error in imposing an enhancement under Guidelines Sec. 2K2.1(b)(6)(B) based on the district court's finding defendant possessed the firearm in connection with another felony (possession of marijuana). 161766U.pdf 03/21/2017 United States v. Thurman Wade, Jr. U.S. Court of Appeals Case No: 16-1766 U.S. District Court for the Eastern District of Missouri - Cape Girardeau
[UNPUBLISHED] [Per Curiam - Before Riley, Wollman and Smith, Circuit Judges] Criminal case - Sentencing. The district court considered defendant's proposed mitigating factors and imposed a sentence it believed to be sufficient but not greater than necessary, and the sentence is affirmed.
