U.S. Court of Appeals Case No: 08-3598
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Per Curiam - Before Bye, Hansen and Benton, Circuit Judges]
Criminal case - Sentencing. The district court did not comply with Rule
11 when it failed to inform defendant of the maximum sentence he could
face if found to be an armed career criminal and of the court's obligation
to calculate the applicable Sentencing Guidelines range and to consider
the sentence factors set out in 3553(a); as defendant objected to the
court's failure to provide the information, the error is reviewed under the
harmless error standard; the court could not say the error was harmless
since it appears that it affected defendant's willingness to plead guilty;
defendant's conviction must be vacated and the case remanded for further
proceedings.
